Consumer Health Data Privacy Policy

This policy applies to consumer health data, personal information that is linked or reasonably linkable to you and that identifies your past, present, or future physical or mental health status, that Nothing Serious LLC collects through the Quests apps and website. It applies to Washington, Nevada, and Connecticut residents and to anyone whose consumer health data is collected in those states.

1. Consumer health data we collect and why

We do not collect precise location data, biometric data, genetic data, or data from health-tracking devices or health platforms (such as Apple Health or Google Health Connect). If that changes, we will update this policy and ask for your consent before collecting it.

2. Sources of consumer health data

  • You, through the information you enter or select in the app.
  • Your device, to the extent the app records the time and date of your check-ins.
  • Other users, to the limited extent they add you to a health-related quest or mention you in one.

We do not obtain consumer health data from data brokers, advertising networks, health-care providers, or any other outside source.

3. Consumer health data we share

We share the following categories of consumer health data only as described in Section 4:

  • Health-related habit and quest information;
  • Check-ins, notes, and completion records for health-related quests;
  • Health-related information in messages you send us.

We do not share inferences. We do not sell consumer health data. We do not share consumer health data with advertising, attribution, or analytics partners.

4. Who we share it with

Processors are bound by written contracts that limit their use of consumer health data to providing services to us.

Affiliates. Nothing Serious LLC has no parent company, subsidiaries, or other affiliates. We share consumer health data with no affiliates.

We do not share consumer health data with any other third party. We will not collect or share categories of consumer health data beyond those listed in this policy without first updating this policy and obtaining your consent.

5. Consent

We collect consumer health data only to provide the quests and features you have requested, or with your opt-in consent. Before we share consumer health data with anyone other than a processor, we will ask for your separate, specific consent that identifies the data, the purpose, and the recipient. You may withdraw consent at any time by contacting us; withdrawing is as easy as consenting.

6. Your rights and how to exercise them

You have the right to:

  • confirm whether we are collecting, sharing, or selling your consumer health data, and to access it, including a list of the third parties and affiliates with whom we have shared it and an active email address or other contact for each;
  • withdraw consent to the collection or sharing of your consumer health data;
  • delete your consumer health data, including from our processors and from backups within the time the law allows.

How to submit a request. Use the contact page at thequestsapp.com/contact, or email nothingserious.team@gmail.com with the subject "Health data request." We verify requests through your account (for example, by sending a code to your phone). An authorized agent may act for you with proof of authorization.

Timing. We respond within 45 days of receiving a request, and may extend once by up to 45 days where reasonably necessary, in which case we will tell you why. We do not charge for requests more than twice in a 12-month period.

Appeal. If we decline a request, we will explain why. You may appeal by emailing nothingserious.team@gmail.com with the subject "Health data appeal" within 45 days of our decision. A different person will review the appeal and respond in writing within 45 days. If we deny your appeal, you may contact your state Attorney General:
